Zero Risk Guarantee
1. Object of the Guarantee
The Zero Risk Guarantee offered by Phosphoro Srl protects the tenant on the bureaucratic and administrative aspects of the booking, guaranteeing:
The existence of the booked property.
The legitimacy of the landlord indicated as the owner or authorized to rent.
The signing of a rental contract between the parties, with mutual assumption of the responsibilities provided.
Entry into the property within the contractually agreed terms.
2. Duration of the Guarantee
The Zero Risk Guarantee ends when the tenant takes possession of the keys and enters the accommodation. Any issues after this moment are not covered by Phosphoro Srl.
3. Exclusions of the Guarantee
The guarantee does not cover:
Compliance with contractual conditions after the delivery of the keys, which remains exclusively the responsibility of the landlord and tenant.
Any discrepancies, problems, or malfunctions related to the maintenance, aesthetic, or functional state of the property.
Any disagreements between the parties not related to the validity or existence of the contract.
4. Refund
Phosphoro Srl will refund the amounts paid by the tenant in the following cases:
The booked property does not exist.
The indicated landlord is not legitimately authorized to rent the property.
No rental contract is signed due to reasons attributable to the landlord or Phosphoro Srl.
Entry into the property does not take place within the contractually agreed terms due to reasons attributable to the landlord or Phosphoro Srl, except for documented force majeure.
Amounts covered by the refund:
All amounts paid to reserve the accommodation, including any deposits.
Any entry costs incurred by the tenant.
Only the amounts provided in the Smartlink are covered; payments not provided for in the Smartlink are not covered.
5. Tenant's Obligations
To activate the Zero Risk Guarantee, the tenant must:
Promptly report, and no later than 10 days from the expected entry date, to PH4YOU Srl any issues related to the guaranteed aspects, by writing to [email protected]
Provide suitable documentation to prove the circumstances for which the guarantee is requested.
6. Limitations of Liability
Phosphoro Srl is not responsible for:
Any discrepancies or shortcomings relating to the state of the property.
Disputes or contractual breaches after the delivery of the keys, which remain the exclusive responsibility of the parties.
Damages or losses resulting from circumstances not directly attributable to the aspects covered by the guarantee.
7. Activation of the Guarantee
The guarantee is included in the General Terms of Service and is considered automatically activated upon confirmation of the booking with payment according to the conditions provided by the SmartLink and upload of the signed contract; it remains valid until the delivery of the keys and entry into the property by the tenant.
